Approximately 38,000 Absentee & Mail-In Ballots are still to be counted.
Former Westchester County Executive is currently holding a slim led over Incumbent Pete Harckham for the NY State Senate seat for the 40th District. Late Tuesday evening Astorino held a 53% to 47% lead after in person voting but with tens of thousands of absentee and mail in ballots still to be counted the race is still very much up in the air.

Harckham won the seat from Terrence Murphy (R-Yorktown) in 2018 after more then a decade of it being in Republican control despite the Republicans having an advantage in registered voters in the district overall. Harckham lost both Dutchess and Putnam Counties in 2018 but the overwhelming Westchester Democratic base (over 70% of that portion of the district are registered Democrats according to NS State Board of elections) carried him to victory in 2018
"We want to get final numbers and see if we can improve on that," Astorino told The Journal News/lohud last night. "This isn't going to be determined until next week." and Harckham's camp was optimistic since there are approximately 38,000 mail in ballots still to be counted. They estimated about 20,000 of those were from registered Democrats.
