Westchester County District Attorney Anthony A. Scarpino, Jr. announced Michael Gagliardi of Somers was arrested and arraigned on child pornography charges after Westchester County District Attorney’s Criminal Investigators executed a search warrant and seized computers and other devices in his home Wednesday.
Specifically, he is charged with:
- Promoting an Obscene Sexual Performance by a Child, a class D Felony
- Possessing an Obscene Sexual Performance by a Child, a class E felony
The District Attorney’s Office received notification from another law enforcement agency that a resident at the Somers address downloaded pornographic images of children.
DA’s Criminal Investigators surveilled the property Monday. Yesterday, Wednesday, they executed a search warrant. They found Gagliardi downloaded on a home computer explicit images of a female child victim, approximately four to six years old. The download was done on Feb. 27, 2019.
DA’s Criminal Investigators squad, with assistance from New York State Police from Troop K Somers barracks, arrested Gagliardi Wednesday. He was arraigned last evening in Bedford Town Court, where he posted $2,500 bail.
He is scheduled to appear in court next July 29, 2019.
The case is being prosecuted by the Investigations Division Cybercrime Bureau.
Note: Concerns circulated in Somers after a homeowner reported incorrectly to NY State Police that two men, “posing as police officers,” were seen in the area Monday, July 8, 2019. Those unidentified men with badges were sworn investigators from the DA’s Office working on this case.
